More than one person or business may be at fault in the accident that injured or killed my relative. What can I do?

If your loved one has been serious injured or killed in a car accident, tire failure crash, rollover accident, single-car crash, boating accident, medical malpractice incident, or other injury, and you suspect that one or more person or is at fault, it is important to hire an attorney to fully investigate the case and help you obtain the recovery that you deserve.

In Florida, if an accident occurs and multiple parties are at fault, the plaintiff can seek recovery for lost income, medical expenses, pain and suffering, and other damages from each of the responsible parties in an amount proportional to their contribution to the cause of the incident. This is called comparative fault.

Such a case could be presented during the pre-suit period (if settled outside of court) or at trial, resulting in a “pro-rata” distribution of the overall damages to each at fault defendant. “Pro-rata” refers to the concept of proportional liability, meaning that each of the defendants would be responsible for their calculated percentage of the total damages. In other words, if Defendant #1 was found to be 60% responsible and Defendant #2 was found to be 40% responsible, and the jury awarded a $100,000 damages verdict, Defendant #1 would pay $60,000 and Defendant #2 would pay $40,000 of the damages.

An expert personal injury lawyer can determine who is at fault in the most complex cases, leaving no stone unturned in investigating your case and obtain for you the highest recovery possible. At the Law Offices of Stephen K. Miller, our attorneys routinely travel across the country to investigate cases and hire the best experts—we go to extreme lengths to achieve the best outcome for our clients.

Our firm accepts personal injury, medical malpractice, and wrongful death lawsuits on a contingency fee basis, meaning you would owe us neither legal fees nor costs unless we recover money damage for you—thus, there is no up front cost to you for us to handle the case. In addition to personal injury, medical malpractice, and wrongful death cases, our firm also handles lawsuits involving divorce, custody battles, domestic violence injunctions, will and probate matters, and criminal defense cases. Our firm has offices in Gainesville, Ocala, Chiefland, Lake City, Palatka, Jacksonville, Daytona, Palm Coast, St. Augustine, Orlando, Kissimmee, Lake Mary, and Melbourne.
