I have an alimony and child support obligation from my divorce, but I make a lot less than I used to. How can I have it reduced?

A divorced party may seek representation from a family law attorney long after a divorce has been finalized when there has been a significant, material, involuntary, unforeseeable change in circumstances that renders the payor unable to fulfill the terms of the court-ordered final judgment. Alimony and child support are usually modifiable after a final judgment has been entered and a possible modification may be based on a change in the responsible party's income as well as other factors. Especially in the current economic climate, the loss of a job could seriously impact a party's ability to pay alimony or child support.

There are other reasons why alimony or child support may be modifiable. Alimony may be modifiable if the need of the receiving spouse has changed due to an increase in income or if the receiving spouse is in a financially supportive relationship. Likewise, child support may be modifiable if the receiving spouse has a substantial increase in pay or if daycare that was once necessary is no longer necessary.
